Draft terms for using Vanguard Digital — an e-commerce platform that helps customers in Zimbabwe shop global stores with transparent landed pricing. Please have these reviewed by your lawyer before relying on them.
Last updated: July 14, 2026
These Terms of Service (“Terms”) govern your use of the website, apps, and related services operated by Vanguard Digital (“Vanguard”, “we”, “us”, or “our”), including vanguarddigital.co.zw.
Legal entity details (to be completed once registration is finalised): [Full registered company name], [Company registration number], [Registered physical address in Zimbabwe], [Support email], WhatsApp support as listed on the Help page.
Vanguard provides a procurement and import-facilitation service. We help you discover products on supported international platforms, obtain an all-in landed price estimate (including applicable duties and delivery where shown), collect payment, purchase goods on your behalf or via our supply partners, arrange international shipping and customs clearance, and deliver or make goods available for collection in Zimbabwe.
We are not Amazon, SHEIN, Takealot, Temu, Alibaba, Apple, Samsung, or any other third-party marketplace. Those brands and platforms remain independent. Product listings, stock, and seller terms on those platforms may change without notice.
By creating an account, browsing, requesting a quote, placing an order, making a payment, or otherwise using Vanguard, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the service. Where we offer a checkbox at signup or checkout (including agreement to these Terms, the Privacy Policy, and our refund rules), your confirmation is required before we process the order.
You must be at least 18 years old and capable of entering a binding contract under Zimbabwe law to place orders.
You must provide accurate registration and delivery information and keep your login credentials secure. You are responsible for activity under your account.
We may refuse service, require identity verification (KYC), suspend, or terminate accounts where we reasonably suspect fraud, abuse, prohibited goods, sanctions risk, chargeback abuse, or other misuse.
Unless we agree otherwise in writing, accounts are for personal or ordinary business purchasing — not for running an unauthorised resale or grey-import operation using Vanguard as an undisclosed front.
Typical flow: you search a supported store or paste a product link → we calculate a landed quote → you pay Vanguard through an approved payment method → we procure the item → goods are shipped, cleared, and delivered or made available for collection.
Quotes may be based on live shelf prices, FX rates, estimated weight/dimensions, ZIMRA-related duty estimates, international freight, last-mile delivery, and Vanguard service fees shown in the quote or checkout summary.
Stock, colour, size, seller cancellations, and platform pricing can change after you pay. If we cannot reasonably fulfil an order as quoted, we will contact you with options such as a revised quote, substitute (with your consent), store credit, or refund according to section 8.
Displayed quotes are estimates until confirmed at checkout or in a written confirmation we send you. Final payable amounts are those shown at payment authorisation.
Exchange rates, carrier rates, and duty classifications can move. If a material change is required after payment (for example customs reclassification or a large weight discrepancy), we will pause fulfilment and seek your instruction before proceeding where practicable.
You are responsible for ensuring the goods are lawfully importable into Zimbabwe. We may refuse or cancel orders for restricted, prohibited, counterfeit, or high-risk items, or where documentation is incomplete.
Customs clearance timelines and ZIMRA decisions are outside our sole control. Delays caused by inspection, documentation, or regulatory holds do not automatically entitle you to compensation beyond what these Terms or applicable law require.
Payment is made to Vanguard using approved gateways and methods shown at checkout (for example Paynow or other processors we enable). Card and mobile-money data is typically handled by the payment provider; we receive payment confirmation and references needed to reconcile your order.
Procurement generally begins only after payment is confirmed as successful. Failed, reversed, or unverifiable payments may result in cancellation.
Unless required by law or our refund policy, chargebacks or payment disputes filed after we have already procured or shipped goods may be treated as a breach; we may share order evidence with the payment provider and pursue recovery of losses where appropriate.
Prices are typically shown and charged in the currency indicated at checkout. Any bank or mobile-money fees charged by your provider are your responsibility unless we expressly state otherwise.
Delivery timelines are estimates only. International transit, customs, and local last-mile partners can cause variation.
Depending on the option you select, goods may be delivered to your address or made available for collection from a Vanguard / partner location (for example a Harare warehouse). You must collect within the period we notify; uncollected goods may incur storage fees or be treated as abandoned after reasonable notice.
Risk in the goods passes to you on delivery to the address you provided or on collection, whichever applies — except where mandatory consumer law says otherwise. You must provide accurate contact and address details and be available to receive the shipment.
Before we procure the item abroad: you may usually cancel for a refund of amounts paid for that order (less non-recoverable gateway fees if your bank or payment provider retains them).
After we have purchased or committed to purchase abroad: cancellations are limited. Cross-border goods are often non-returnable to the original platform. We will still help where the item is defective on arrival, materially not as described, or wrongly fulfilled by us.
Damaged or missing items must be reported within [7] days of delivery/collection with photos and order details, unless a longer period is required by law.
Refunds, where approved, are returned via the original payment method or as store credit where the payment channel cannot reverse easily. Timing depends on banks and payment providers.
Duties, freight already incurred, and procurement costs that cannot be recovered may be deducted from refunds where the cancellation or return is not due to our error.
You must not use Vanguard to order illegal goods, controlled substances, weapons, counterfeit products, or anything prohibited under Zimbabwe law or carrier/customs rules.
You must not attempt to hack, scrape at abusive scale, reverse engineer, overload, or interfere with the platform; create fake accounts; abuse affiliate or referral programmes; or use the service for money laundering or fraud.
We may remove content, cancel orders, or report activity to authorities or payment partners where required or reasonably necessary.
If you join our affiliate or partner programme, additional programme rules, integrity policies, and commission terms apply. Those rules form part of your agreement with us when you enrol.
We may withhold or claw back commissions for fraud, self-referrals, cancelled orders, or policy breaches.
Vanguard branding, site design, software, and original content are owned by us or our licensors. You receive a limited, revocable licence to use the site for personal shopping and lawful business purchasing.
Product images and trademarks belonging to third-party brands remain their property and are shown for shopping and identification purposes.
The service is provided on an “as available” basis. We do not warrant uninterrupted access, error-free quotes, or that a third-party platform will continue listing a product at a given price.
Third-party sites and logistics partners have their own terms. We are not responsible for their independent failures except to the extent caused by our negligence or as mandatory law requires.
To the fullest extent permitted by law, Vanguard is not liable for indirect, incidental, special, or consequential losses, including lost profits, lost data, or business interruption.
We are not liable for carrier delays, platform stock changes, seller cancellations, customs decisions, FX volatility, force majeure events, or failures of payment networks — except where caused by our wilful misconduct or as mandatory law provides.
Our aggregate liability arising out of any order is limited to the amount you paid Vanguard for that order, except where applicable Zimbabwe law requires a different result (including any non-excludable consumer rights).
We are not in breach for delay or failure caused by events beyond our reasonable control, including natural disasters, war, epidemic, government action, ZIMRA or customs holds, strikes, major network/payment outages, or platform API failures.
These Terms are governed by the laws of Zimbabwe.
If a dispute arises, contact support first so we can try to resolve it. If unresolved, courts of competent jurisdiction in Zimbabwe (preferentially [Harare]) shall have jurisdiction, without prejudice to any mandatory consumer protections.
We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may also be highlighted on the site or by email where appropriate.
Continued use after the updated Terms are posted constitutes acceptance, except where mandatory law requires a different consent process.
